General Terms and Conditions of Sale

These general terms and conditions of sale constitute the supply contract of BARPA. Every order received will continue to be accepted and executed under these conditions.

1. PRODUCTS / CATALOG

1.1 The characteristics of the products included in the general catalog of BARPA and on the B2B e-commerce platform my.argon.pt are indicative and may be changed without prior notice.

1.2 Product images in the general catalog of BARPA and on the B2B e-commerce platform my.argon.pt are for illustrative purposes only.

1.3 Technical data sheets can be consulted on BARPA’s website (www.barpa.eu) or by email at info@barpa.eu.

2. PRICES

2.1 The price list is the document that references the codes, sales multiples, and prices corresponding to each product. These data are linked to BARPA’s current digital catalog.

2.2 Prices are presented in euros, according to the initial negotiation between the companies involved.

2.3 The price includes the products properly packaged.

2.4 Delivery is not included.

2.5 Other taxes or fees are not included.

2.6 The price list may be changed without prior notice and is valid until the next edition comes into effect.

3. CREDIT OPENING

3.1 After completing the credit opening form and analysis, BARPA may authorize supply on credit.

3.2 BARPA reserves the right to modify or cancel the credit supply without prior notice.

4. SUPPLY / SHIPPING

4.1 BARPA is responsible for providing the ordered products according to the agreed conditions.

4.2 Whenever there is a reason to charge fees related to transportation, special packaging, or collection fees, these will be properly referenced in the order confirmation sent by BARPA to the client in response to the order email.

4.3 The products, after being dispatched, including during transport, are at the client’s risk and expense.

4.4 All confirmed orders have a maximum of 3 business days to be prepared and ready for dispatch (this may change depending on volume or stock availability). Deliveries may be made by BARPA or by the client, depending on the initial negotiation. If BARPA is responsible for delivery, it will be carried out by a transport operator, and unforeseen events unrelated to BARPA may occur.

  • Order confirmation consists of the client’s validation of all elements contained in the confirmation, such as the code, reference, quantity, price, delivery time, shipping cost, etc.
The order must be confirmed in writing (email) in response to our order confirmation email.

4.5 Orders will only be accepted if they respect the sales multiples presented by BARPA in the order confirmations.

4.6 The minimum order value must be defined during the initial negotiation.

5. PAYMENT

5.1 Payment terms must be defined during the initial negotiation.

6. RETURNS

6.1 To request a product return, you must contact BARPA and request the return form. In this form, you must enter all necessary data so that we can carry out a correct analysis. Once completed, the form must be sent to quality@barpa.eu.

Returns are not accepted in the following cases:

  • Purchases made more than 30 days ago.
  • Products that are not part of our current stock, as indicated in the order confirmation.

If your return request is accepted, BARPA will send back the form with a return code. This form must always be attached when sending the material to our facilities, as well as a return/transport document. We will not receive materials without the corresponding form or a valid return code, nor without a return document. Returns are only accepted if the products are in the original and proper packaging, as well as in the quantity corresponding to the sales multiple. The cost of any return will be borne by the client, except for returns resulting from errors for which BARPA is responsible.

7. CLAIMS

7.1 BARPA views customer claims as a privileged means of improving its service level. To file a complaint, you must contact BARPA and request the claims form. In this form, you must enter all necessary data so that we can conduct a correct analysis. Once completed, the form must be sent to quality@barpa.eu. The quality department, after consulting all documents related to the claim and after hearing the parties involved in the process, will evaluate it impartially and provide a response. A maximum period of ten working days is set to respond to the client, without prejudice to situations where it is necessary to consult other entities. This situation must be reported to the client within the maximum period mentioned.

7.2 Claims related to non-conformity of quantities or sending of incorrect codes must be made within a maximum of 5 business days from the date of receipt by the client to allow for internal analysis of the non-conformity.

7.3 Claims for material damaged during transport must be made at the time of delivery, on the transport form, always indicating the number of damaged packages. (Note: if you only mention “subject to verification or confirmation” or do not mention the number of affected packages, it will not be valid for the claim.) At the same time, BARPA must be informed of the existence of such damage. If this is not the case, in the event of a subsequent claim, BARPA cannot be held responsible, and all liability will be borne by the client.

7.4 In the case of unfounded claims, the material will be returned to the client at their expense.

7.5 All costs related to the management of claims caused by BARPA are borne by BARPA.

8. AFTER-SALES SERVICE

8.1 If tool repairs are required, the client must request a quote at the following email address: info@barpa.eu. The cost of repair and transport will be borne by the client.

8.2 If it is necessary for BARPA’s technical department to travel for the analysis or repair of any product or installation, and if the fault or incorrect installation is the client’s responsibility, the travel and labor costs will be borne by the client.

9. DISPUTES

In the event of a dispute, the only competent court is that of the district of Gondomar, to the exclusion of any other.
